ปัจจุบันมี Youtuber เกิดขึ้นมากมาย สร้างงานเผยแพร่บน Youtube หลากหลายรูปแบบ หลากหลายเนื้อหา และมีการนำเอาข้อมูล วิดีโอ มาใช้ซ้ำมากมายเช่นกัน ซึ่งจะต้องระมัดระวังไม่ให้เกิดการละเมิดลิขสิทธิ์ หรือเกิดการใช้งานที่ไม่เป็นธรรม

การใช้งานที่เป็นธรรม หมายถึงข้อบังคับหรือกฎเกณฑ์ที่จะบอกว่า เราสามารถใช้งานที่ได้รับการคุ้มครองลิขสิทธิ์ภายใต้เงื่อนไขได้อย่างไรโดยไม่ต้องได้รับอนุญาตจากเจ้าของไฟล์งานหรือข้อมูลนั้น  แต่ละประเทศจะมีกฎเกณฑ์ที่แตกต่างกันไปในเรื่องการใช้ข้อมูลของคนอื่นโดยไม่ได้รับอนุญาต ตัวอย่างเช่น ในสหรัฐอเมริกา งานประเภทวิพากษ์วิจารณ์ วิเคราะห์ วิจัย การสอน หรือ รายงานข่าว จะสามารถนำไปใช้ได้โดยไม่ต้องขออนุญาต และในแต่ละเหตุการณ์ที่เกิดการละเมิด ศาลจะเป็นผู้วิเคราะห์ถึงความเป็นธรรม ดังนั้นผู้ที่จะใช้ไฟล์งานหรือข้อมูลซ้ำอย่างถูกกฎหมายจะต้องได้รับคำแนะนำจากผู้เชี่ยวชาญก่อนที่จะมีการอัพโหลดไฟล์วิดีโอที่สร้างขึ้น  เพราะเมื่อเกิดการฟ้องร้อง ศาลจะมีการประยุกต์ข้อกำหนด 4 ข้อนี้เข้ากับการพิจารณาในแต่ละกรณี
